  • Overview

    The Litigation Counsel will handle disputes, advising internal business clients, and litigating cases as counsel-of-record (both independently and under Senior Counsel supervision) and/or in collaboration with outside counsel. The Litigation Counsel will work on a wide range of matters, including general commercial disputes, employment litigation, intellectual property claims, product liability claims, advertising/consumer disputes, insured matters, third-party subpoenas, and other more.  The Litigation Counsel will also provide general legal advice and support on business matters in a fast-paced environment. This role requires close collaboration with various business units, including Operations, Real Estate, Human Resources, Merchandising, and Finance.

    Essential Functions

    • Analyze claims and formulating litigation and early case resolution strategy
    • Conduct fact investigations and legal research
    • Draft legal papers, including case-related correspondence pleadings, briefs, declarations, discovery demands and responses
    • Represent Sprouts during court proceedings (including federal and state court appearances), arbitrations, mediations, and depositions
    • Advise business clients and senior management on strength of claims and defenses, dispute avoidance and resolution
    • Respond to third-party subpoenas
    • Manage and work collaboratively with outside counsel, as needed
    • Manage and supervise e-discovery
    • Partner with Senior Counsel, Employment and Litigation, and work closely with other senior in-house lawyers on a broad variety of litigation, dispute resolution and risk management issues
    • Prepare witnesses for hearings and depositions
    • Maintain the company’s litigation matter management system
    • Analyze and report on litigation trends
    • Assist with the company’s records retention/litigation hold process
    • Work well as part of a strategic team in a fast-paced, deadline-oriented work environment, completing multiple complex tasks simultaneously.

     

    Knowledge, Skills, Abilities and Physical Requirements

    • 3-4 years civil litigation experience with a law firm or corporation
    • JD from an ABA accredited law school
    • BBA/BA/BS degree required
    • Strong research and writing skills
    • Strong communication and oral presentation skills
    • Ability to perform in a complex cross-functional business environment
    • Excellent interpersonal skills, including telephone and email etiquette
    • Excellent attention to detail
    • Self-starter/independent worker with a high level of creativity, and an ability to creatively solve problems with a variety of variables
    • Flexible team-player with a positive, proactive attitude
    • Strong time management skills; able to multitask, prioritize and manage own workload and to work well under pressure
    • Experience with labor & employment litigation, ADA access litigation, and California-specific claims (including but not limited to PAGA litigation and Prop 65 litigation) preferred but not required 
    • Capable of operating office equipment such as computer, fax, scanner, etc.
    • Proficient in Microsoft Word, Excel, PowerPoint and Outlook
    • Must have unrestricted authorization to work in the United States
